Court Proceedings

When social services become involved with your family, the situation can sometimes lead to court proceedings. This is a worrying and stressful time, but you do not have to face it alone. At Howard & Co., we provide clear, compassionate advice and strong representation in all types of social care cases. We will explain what is happening, what your options are, and stand by you throughout the process.

We deal with all types of social care court proceedings

Social services may apply to the court in different situations, for example:

  • Asking the court to monitor the way you are caring for your child.
  • Seeking permission to remove your child from your care, either temporarily or permanently.
  • Applying for care or supervision orders to give them a greater role in decision-making for your child.

We represent parents, guardians, children, and other family members in these cases. Our priority is always to protect the wellbeing of children (as our foremost priority); to protect your rights; and to ensure the court has a clear understanding of your family circumstances.

Orders

The court can make different types of orders in social care proceedings, including care orders, supervision orders, and interim orders. In many cases, there are ways to avoid a child being removed from their family. This could involve putting extra support in place or exploring whether other family members can step in to care for the child. We will work with you to consider every option, advise you on what the court is likely to look at, and do everything possible to keep your family together.

Future Action

If your child has already been removed from your care, this does not have to be the end of the matter. We can advise you about challenging the decision now or in the future if your circumstances change. We can also help you apply for contact arrangements so that you can continue to have a relationship with your child. Our team will guide you through each step and ensure your voice is heard.

Our Fees for Handling Social Care Court Case Proceedings

Legal aid is available to parents and anyone with Parental Responsibility for a child, regardless of their financial situation. Other relatives or interested parties may also qualify for legal aid depending on their circumstances. Where legal aid is not available, we can offer clear and affordable fixed fee options so that you know exactly what to expect from the outset.
